When am I entitled to receive a copy of the Procedural Safeguards Notice?

The school must give you a copy of the Procedural Safeguards Notice at least once each school year. You must also get a copy:

  • when your child is first referred for evaluation, or when you request an evaluation;
  • the first time in a school year that you file a state complaint, and the first time in a school year that you file a due process complaint;
  • when the school decides to make a disciplinary removal that is a change of placement (you get it the same day the decision is made); and
  • any time you ask for one.

Many districts also post the notice on their website. Posting it doesn't replace the copies you're entitled to receive.
